We operate in strict accordance with the Digital Millennium Copyright Act (DMCA), a United States federal law that sets forth the procedures for reporting and responding to allegations of copyright infringement.

Submitting a DMCA Takedown Notice

If you are a copyright owner or an authorized agent acting on behalf of a copyright owner and you believe that your copyrighted material has been reproduced, distributed, or displayed on our platform without your authorization, you may submit a formal DMCA takedown notice. This notice must be submitted in writing and should include the following information, presented clearly and accurately:

  • Your full legal name, mailing address, telephone number, and a valid email address where you can be contacted.
  • A detailed description of the copyrighted work that you claim has been infringed, including any registration details or other identifying information that will help us verify your ownership.
  • Identification of the material you believe to be infringing upon your copyright rights, along with sufficient information for us to identify it within our platform.
  • A clear statement, made in good faith, declaring that you have a reasonable belief that the use of the copyrighted material in question is not authorized by the copyright owner, its agent, or the law.
  • A declaration, made under penalty of perjury, that the information provided in your notice is accurate, and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  • Your physical or electronic signature.

Our Response to DMCA Notices

Upon receipt of a valid DMCA takedown notice that meets all of the above requirements, FadeSculpt will initiate a review process. If the claim appears to be legitimate, we will remove or disable access to the allegedly infringing material. We will also make a good faith effort to notify the user responsible for uploading the content in question, providing them with an opportunity to respond through a counter-notification.

Filing a Counter-Notification

If you believe that the material was removed or disabled in error, you may file a counter-notification with us. This counter-notice must include:

  • Identification of the material that was removed or disabled and its prior location.
  • A statement made under penalty of perjury, asserting that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  • Your full name, mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal district court in your area, or if outside the United States, any jurisdiction in which FadeSculpt may be found.
  • Your physical or electronic signature.

Review and Restoration

Upon receiving a valid counter-notification, we will provide a copy to the original complainant and inform them that the material may be restored after a specified period, unless they file a legal action seeking a court order to prevent the restoration of the content.

We strongly advise all parties involved to ensure that all information submitted in a DMCA notice or counter-notice is accurate and truthful. Misrepresentations may result in legal liability.
